Terms of Service

These Terms govern your use of andrew.khanoff.com and the freelance services I provide as an independent contractor.
Engagements via Upwork
Most work is contracted through Upwork. Those engagements are governed by the Upwork Terms of Service, the Upwork escrow and payment system, and the specific contract or statement of work agreed there. These Terms supplement that contract; where they conflict for an engagement, Upwork’s terms and the agreed contract prevail.
Services
Platform and automation engineering, AI/LLM and RAG infrastructure, and observability work, scoped per contract. I provide services with reasonable skill and care, but I do not guarantee any specific business outcome.
Scope & changes
Work is defined by the agreed scope and milestones. Changes to scope require mutual agreement and may affect timeline and price.
Intellectual property
On full payment for a deliverable, ownership of the custom work product created for you transfers to you. Pre-existing materials, and third-party or open-source components, remain owned by their respective owners and are licensed (not assigned) for use within the deliverable. I retain the right to my general knowledge, skills and experience.
Confidentiality
Each party protects the other’s confidential information and uses it only for the engagement.
Payment
Via Upwork — fixed-price milestones or hourly billing — unless otherwise agreed in writing.
Disclaimers & limitation of liability
Beyond the agreed scope, the website and services are provided “as is” without further warranties, and I do not warrant that they will be uninterrupted or error-free. To the extent permitted by law, my total liability for an engagement is limited to the fees paid for that engagement, and I am not liable for indirect or consequential damages.
Website use
Do not misuse the site, attempt to disrupt it, or use it unlawfully.
Governing law
These Terms and your use of the website are governed by the laws of Ukraine. Engagements contracted on Upwork are additionally governed by Upwork’s terms and the applicable contract.
Changes
I may update these Terms; the revised version will be posted here with a new date.
